In this notice, "SIEMEX", "we" and "us" refer to the responsible party. All requests and notices about your information are handled by email.

02What we collect

In the study (survey and interviews)

• Contact details, only if you request your audit: name, business name, email, phone or WhatsApp (optional) and your website or main social media profile.
• About your business: industry, city, state or province, country, years in business, team size and your role.
• The channels and tools you use, your approximate monthly ad spend, and your opinions and challenges.
• In interviews you agree to: notes from the conversation and, only with your explicit permission at the start, a recording.
• Public information about your business that we review for the audit (website, Google profile, social media).

In the app (plataforma.siemex.xyz)

• Your account: name, email, password (stored encrypted; nobody can see it) and preferred language.
• Your business details: name, industry, city, country, website and business phone or WhatsApp.
• Numbers from the accounts you connect (website, Google Business Profile, Facebook, Instagram and Google ads): daily totals such as visits, times you showed up on Google, calls, direction requests, ad spend, clicks and number of conversations. Access to those accounts is read-only and you can remove it at any time.
• WhatsApp messages, only if you connect your number: so you can read and reply from the app, we store the conversations of your WhatsApp Business number: the profile name and number of whoever writes to you, the text of the messages, the automatic replies you set up, which ad each conversation came from, and their answers to the assistant's questions. Photos, audio and documents aren't stored; only a note that they arrived. For these conversations your business is the controller of its customers' data and SIEMEX processes it only on your behalf, as a processor, to provide the service: we don't use it for anything else, we don't sell it and we don't contact your customers.
• What you do in the app: your decisions on recommendations, your service requests, the prices you approve and the messages you send us.
• Technical security data: sign-in dates and times and the IP address of requests, to prevent abuse.

We don't collect sensitive information such as health, ethnicity, religion or sexual orientation. Please don't include it in open-ended answers or messages.

03How we use it

Required purposes

• Analyze study answers, always in aggregate.
• Prepare and send your free audit, and contact you for the call, if you asked for them.
• Invite you to be one of the first users of the app, if you asked.
• Give you access to the app, show you your dashboard and prepare recommendations.
• If you connect WhatsApp: receive and send your business's messages, send the automatic replies you set up and show you the conversations.
• Handle your service requests: review them, send you a price, do the work and keep you updated.
• Issue invoices when you hire a service.
• Keep the app and your account secure.

Optional

• Send you news and offers from SIEMEX by email or text message.

We only use your information for the optional purpose if you agree to it separately (the survey has its own checkbox). You can withdraw that consent at any time by emailing us or replying to any message; it doesn't affect your audit or your use of the app.

We never publish your business's name, your numbers or your individual answers without your written permission. Any study results we share will be percentages and trends across all participants.

04Who we share it with

We don't sell or share your personal information for advertising or for money. It's only processed by service providers we use to operate, following our instructions:

Your information is handled from Mexico, and some of these providers may store it in the United States or other countries, where local laws apply. Outside these cases, we would only disclose information if legally required to do so.

05How long we keep it

• Study contacts: up to 24 months after the study ends, or sooner if you ask us to delete them. After that, answers are kept only in anonymous form.
• Interview recordings: deleted no later than 6 months after the interview.
• Your app account and its data: while your account is active. If you close it, we delete it within 90 days, except invoices for services you hired, which we keep for 5 years for tax purposes.
• WhatsApp conversations: while your number is connected. If you disconnect it or close your account, we delete them within 90 days. You can ask us to delete a conversation sooner.
• Technical security data: up to 12 months.

06Cookies and browser storage

siemex.xyz doesn't use tracking or advertising cookies. When you take the survey, Google Forms may use its own technical cookies under Google's privacy policy.

The app uses a single, essential cookie to keep you signed in (it lasts 7 days) and saves your chosen language in your browser. It doesn't use advertising or tracking cookies.

07Your rights

Wherever you are, you can ask us to access the information we hold about you, correct it, delete it, or stop using it for a particular purpose. You can also withdraw your consent or ask us to close your app account.

• What you'd like us to do

We'll respond within 30 days. We may ask for information to confirm your identity before acting on the request.

How to delete your data

To delete your data, including data we received through Facebook, Instagram or WhatsApp, email contacto@desarrollo.siemex.xyz with the subject “Delete my data” and include your email or WhatsApp number. We delete it within 30 days and confirm once it's done.

If you messaged a business that uses SIEMEX on WhatsApp and want your conversation deleted, you can ask that business or ask us directly the same way.

08Security

We use reasonable administrative, technical and physical safeguards to protect your information, including encrypted connections, encrypted password storage, access limited to authorized SIEMEX staff and backups. If a breach affects your information, we'll notify you.

09Changes to this notice

If we change this notice, we'll post the new version on this page with its update date. If the change is significant and we have your contact details, we'll let you know.

10Questions and complaints

Write to us first at contacto@desarrollo.siemex.xyz and we'll do our best to resolve it. If you're in Canada and aren't satisfied with our response, you can contact the Office of the Privacy Commissioner of Canada. If you're in the United States, you may contact your state attorney general's office.

11Consent

By checking the consent box in the survey, or by activating your access to the app, you confirm that you've read this notice and agree to the use of your information for the required purposes above. The optional purpose needs your separate agreement.

This notice was prepared with reference to Mexico's federal personal data protection law, Canada's Personal Information Protection and Electronic Documents Act (PIPEDA) and applicable U.S. state privacy laws. The Spanish version is the legally binding notice under Mexican law; this English version is provided for your convenience.
